Illinois Harassment Defense Lawyers

Harassment in the workplace can occur in a variety of contexts, and almost every workplace now has required training on at least an annual basis to prevent it. The Chicago area harassment defense attorneys at The Sotos Law Firm have the experience necessary to conduct that training, perform investigations of harassment claims to determine the validity or veracity of any claims against you or your agency, and to expertly and effectively defend your organization against such allegations.

Illinois Age Discrimination Attorney

Although employees are trained on harassment and how to recognize it in the workplace, it is not always well understood as a form of employment discrimination. Violations of Title VII of the Civil Rights Act of 1964, along with the Age Discrimination Act of 1967 (ADEA), and the Americans with Disability Act of 1990 (ADA) have all had an impact on the number of employment discrimination claims. Any unwelcome conduct that is based on sex, national origin, race, age or disability can be characterized as harassment. What makes it illegal is when the harassment becomes a condition of continued employment, or interferes with work performance by creating an environment of intimidation, fear or hostility in the workplace.

Independent Investigations of Discrimination Claims

Once a claim is received, a preliminary investigation is performed. In many cases, particularly if the claim involves upper management or someone of authority, an outside independent investigation may be requested. The harasser can be a co-worker, supervisor or person of authority in another department, or an agent of the employer. And the victim does not have to be the target of the harassment, but rather, simply someone affected by the offensive conduct.
